Gay porn star "Tiger" (Christopher Dauenhauer) at first denied knowing Tobias, but has since admitted having sex with him and traveling on his jet.
JUPITER, Fla. -- The drowning death of a prominent hedge fund manager has become a lurid tale involving drug use, a gay porn star, and marital infidelity that has transfixed Wall Street.
Seth Tobias was found dead in the pool of his $3 million Jupiter mansion on Sept. 4. Investigators said they found Filomena Tobias holding her husband's body on the steps of the pool and that Seth Tobias' body had abrasions on his nose, forehead and back, according to a police search warrant.
Tobias was one of Wall Street’s gilded elite -- the founder of a $300m hedge fund.
Several of Tobias’s former colleagues noted that he had a reputation for wild living -- “I’d have to [guess] he died in the saddle with a high-priced hooker while doing cocaine,” one anonymous trader wrote -- but most people mourned the loss of a dynamic and generous financial wizard who had become well known as a television analyst.
Before his death, Tobias seemed to be living a dream life with a beautiful socialite wife and all the trappings of extreme wealth, from the luxury cars in his Florida garage to his Cayman Islands bank account, his private box at the Philadelphia Eagles football stadium and his home on a private golf course behind the Ritz-Carlton hotel.
Yet a painfully public falling-out between Tobias’s wife, Filomena, and four of his brothers who are beneficiaries of his will has transfixed Wall Street and dumbfounded the rest of his family. They have had to endure salacious allegations that Tobias was squandering at least part of his fortune on rampant cocaine abuse and male prostitutes.
New information shows a volatile marital past, WPBF News 25 reported.
Filomena Tobias, 41, was arrested by Palm Beach police in February 2006 after she slapped her 44-year-old husband in the face during a heated public argument, according to an arrest affidavit.
According to the report, Filomena and Seth were screaming obscenities at each other in front of the trendy Palm Beach restaurant Cucina Dell'Arte when Seth Tobias accused his wife of sleeping around, WPBF reported.
Investigators said an intoxicated Filomena Tobias slapped her husband in the face, but later told police that she was just defending herself. In the report, Filomena accused her husband of using cocaine and claimed that he regularly beat her. Seth had been arrested by West Palm Beach police on domestic battery charges in 2005, according to the report.
Two of Seth Tobias' brothers, Spence and Sam Tobias, claim that Filomena Tobias "intentionally killed" their brother "by asphyxiation and drowning," according to a court document signed Nov. 15.
Billy Ash, a self-proclaimed former escort agency head who refers to himself as "Mr. Madam," told WPBF that Filomena Tobias told him that she had drugged Seth Tobias and lured him into their mansion pool with the promise of sex with a gay porn star nicknamed "Tiger.".
The porn star, who was subject of an intense search in early December by lawyers involved with the case, told WPBF on December 11 that claims made about his relationship with the deceased hedge fund manager are "absolutely incorrect."
Chris Dunhauer, who said he goes by the name "Tiger" because of the tiger-like striped tattoos down his side, told the station that he does not recall ever knowing Seth Tobias or his wife, Filomena Tobias.
"The assistant of Seth Tobias -- who moved over to San Diego [Ash] -- he is the one that is saying that I was a recent boyfriend of [Tobias's] up until he died in September, and that is just absolutely incorrect," Dunhauer said.
But his story is changing, according to New York Daily News.
Tiger now says the memories are coming back, according to a gossip column in the Daily News. "He put on some weight since we used to hang out," say Tiger. "But we definitely had sex. We got together a couple of times in Florida, and also in New Jersey and Vegas.
"I often went with Seth to great destinations. He may have talked about me with Filomena during his drug binges. I may have been the only guy he'd ever been with. He may have thought I was his boyfriend. She may have gotten jealous."
Filomena, 41, reportedly accompanied Seth, 44, on one trip to Cupid's. Tiger now says there was another night when Filomena and a girlfriend sought him out in L.A. "They wanted to party with me," says Tiger. "They were good-looking girls in little miniskirts. They were very aggressive."
Tiger makes other claims about that night, wild stuff that, on the advice of counsel, we will refrain from repeating here. Filomena's lawyer, Gary Dunkel, says the story is "completely rubbish. She's never met [Tiger]."
Tiger, 31, says he'd like to share his story with police in Jupiter, Fla., where Tobias died at his mansion. A police spokesman, Sgt. Scott Pascarella, says: "I don't know what level of interest we have in speaking to him."
Ash, who claims he was the Tobiases' personal assistant, corroborates that "Seth talked about Tiger for a year," but maintains that "Tiger was nothing in the whole scope of things. I don't believe he was there the night Seth died."
Ash has been arrested 11 times for male prostitution and other offences. He left for San Diego after Tobias’s death, but was interviewed by police, who have been sceptical about his allegations.
A spokesman said investigators were still waiting for toxicology results that may show how much cocaine -- if any -- Tobias had taken before he died. Police continue to treat the case as an accident.
Yet the Tobias brothers are taking Ash seriously, not least because they also accuse Filomena of hiding a will in which they were named as beneficiaries.
Under a Florida law known as the “slayer statute”, a wife cannot benefit from her husband’s estate if it is proved that she “intentionally or unlawfully” caused his death.
Ash failed to turn up for a scheduled deposition of his evidence in the case, which is likely to be tried before a probate judge in February. Filomena’s lawyers dismissed his allegations as malicious fantasies and noted that the Tobias brothers had “failed to provide a scintilla of evidence”.
