Opponents of marriage equality filed another legal attempt Monday to block future same-sex marriages in California, Sacramento Bee reports.
A petition signed by what the Bee describes as "a handful of politicians from across the region" was filed with a Sacramento County judge.
It questions the validity of new gender-neutral marriage licenses that clerks are now (as of 5 pm today) required to use for all marriages.
Instead of "bride" and "groom," the new forms refer to "Party A" and "Party B."
The petition seeks to stop the California Department of Health's Office of Vital Records, which oversees marriage licensing, from using gender-neutral forms without prior authorization from the state Legislature, the Bee reports.
It argues that using the new forms would raise questions about the validity of those marriage licenses and "may lead to decades of litigation."
According to a report by Associated Press, the petition was crafted by a conservative legal group, "United States Justice Foundation."
That group's leader, Gary Kreep, two weeks ago offered to provide pro-bono counsel to any clerks willing to challenge the Supreme Court's May 15 ruling.
Several right-wing news sites reported on May 29 that Kreep was offering to challenge any part of the marriage equality ruling, claiming, bizarrely, that the state's Supreme Court lacks authority to overrule a statute that it deems unconstitutional.
The Bee reports that Superior Court Judge Patrick Marlette has scheduled a hearing on the petition at 1:30 pm Tuesday.
Several couples have already been married in the handful of counties that begin issuing licenses today at 5 pm. Hundreds more are expected to get licenses beginning at 8 am tomorrow when clerks throughout the state are required to begin using the new forms.
